I need help with this question ASAP! I have a 72 hour on my hands right now, and two small children.

Yes, you can be evicted in the winter months even if you have small children.

It's time to start contacting everyone you know to see if you can borrow enough to prevent the eviction. If that doesn't work, try local churches and civic groups. I know that NJ has something called the Homelessness Prevention Program that will give loans to qualified people to prevent eviction. Contact the court clerk to see if your state has something similar.

I wish I had a better answer for you (I hope I'm wrong), but I don't think it makes a difference if you have children in the home.

What are the reasons for your being evicted? Did you sign a lease? Did you break an agreement?

Maybe we can help from that angle, but simply having children, I'm afraid that isn't going to make a difference.

Do you have someplace that you can go? Like the above poster, there may be organizations that can help or shelters that you could stay for a short amount of time until you find something else.

If the 72 hour warning is from the COURT, then you've probably got a week. If it's from your LANDLORD, you've probably got a month or more.
