Hi I am OPT status presesntly and recently joined a company in Nov 17,2008.My OPT started on Sep 9th 2008.I came to USA on DEC 14,2006.
My Company has cut both Fica/Medicare taxes from my pay checks. When I talked to them they said that it's their policy and I can apply for a rex refund when I fill out my tax returns.

So When I file for my annual tax returns will I get the whole amount back which was cut for FICA/MEDICARE.

Varun

You will still need to write an email to your employer for refund of FICA taxes.
F1/OPT is exempt from residency for 5-years.

You can also refer then to IRS Publication 519: Tax For Aliens, p. 48; Students and Exchange Visitors.

Your employer may still be in a position to return the taxes. They also don't need to pay their own share. You will not get back, when you file your tax return.

You will have to file Form 843 separately. Read about filing Form 843: Your U.S. Tax Return: Social Security and Medicare (FICA) Taxes for Non-resident Exempt Individual (http://taxipay.blogspot.com/2008/03/non-resident-exempt-individual-social.html)
