View Full Version : Need to know about a separation agreement in Fl.

I just wanted to get someone's opinion. If a separation agreement is drawn up, all monies paid to my spouse, and everything else has been taken care of that was agreed on. There was no agreement as to how fast a divorce had to be filed for. My question is can she push a filing date by saying if it is not filed by a certain date that she will ask for alimony, which she declined in the agreement. I guess what I am asking to know is can a filed and notorized separation agreement be dissolved, for lack of a better word, if there is a delay in filing. She has already moved to another state and just keeps pushing the issue. I am waiting until I have the money to file.

An alimony claim and an award of alimony from a judge are two different things, of course. A purported 'waiver' of alimony can be an incubator for litigation.
