I got in a car accident and was given a failure to yield ticket even though the other car ran a red light. Any way to fight this?

Here is what happened...

I was waiting in the intersetion for traffic to clear to make a left turn. The light went from green to yellow to red. The intersection did not clear until the light turned red. When the light turned red red I needed to clear the intersection so I started my left turn. All the traffic had stopped for the red. The intersection was clear when I started my left turn but a car ran the red light and hit the rear right door and quarter panel of my car. I was cited by the officer for failure to yield even though the other guy ran a red light. Since there were no witnesses the other guy was not cited even though it was evident he ran the red light. I don't understand how I got the ticket when he ran the red light. How am I supposed to yield to a car that runs a red light. He should have stopped.

Any advice?

Well you always have the right to fight anything in court.

But according to the law ( at least here in Georgia) and what at least used to be the law in Arizonia some years ago.

You can not legally enter an intercession unless it is clear to completely go across.

So if you entered the cross road and had to stop and wait on traffic, you violated the law ( people do it every day but it is still illegal)

Unless you can enter and completely move though the intercession, you can be written up.

Now the proper ticket would be failure to obey a traffic control device

If there were no other witnesses, the officer probably assumed that the light was green, which is why both vehicles were moving.
