If the ex-partner is unfit and a danger to the children and he can prove it, he has a good chance of getting sole custody (if that's what you're asking).

If the mother is not unfit he has a good chance at shared custody but probably not physical custody.

A LOT depends on the State and the circumstances, whether he is a better parent, whether he's been supporting the children and visiting with them, the ages of the children, his general stability in life, her general stability in life.

If you are considering adoption it will be impossible without the consent of the mother.

Sure - if you can prove the accusations (perhaps through CPS or something similar) and he can support the family (sorry, I misread and thought there were 4 with the "ex") you should have a really good chance.

You just never know what a Court is going to decide until you are standing in front of a Judge.

Does "he" have legal visitation, something set up by the Court, and has he been proven to be the father?
