View Full Version : I want to get temporary custody of my 8yearold niece

My sister is 24yearsold with 4 children's with no where for them to live.My niece who I want to get custody has been staying with me since she was 2years old off and on.But now she's been with me for 3years straight.I ask my sister to give me custody of her until she get her self together but she said no.I think she don't want to give her to me because she think she will lose her welfare benefits.I ask my niece did she want to stay with me for good and she said yes she don't want to live with her mother anymore. What should I do.:confused::confused:

Please contact an atty or your child protection dept . If this child is in danger of emt abuse or worse then you need to protect her from being removed from your home on any just because the I can reason . That is the frist step good luck been there and 12 years later still trying

I don't know as long as you have physical custody, legal or not, if you want to change the situation. Unless the mother puts the child in danger I don't see you getting legal custody instead of the mother. One parent is sometimes living in a shelter with the children and the other parent is unable to get custody.

Unless you have some reason to start something with your sister I would leave this alone for the moment. If you feel you want to go ahead, consult with an Attorney.

CPS has no involvement in this. The child actually has lived with the aunt for years and is not subject to the mother's abuse (if there is abuse involved).

I do not see any complaints/concerns about the other children so I don't know what the exact situation is.

Sound advice I anwered on my own history and case however some times letting someone know of the amount of time you have cared for child does matter and may be important however the advice from Judy is the best first step thanks for checking me " No advice is always better then wrong advice "
