I have a friend who just got married with his wife (in Vietnam) about a year ago. All the paperwork are signed and now his wife is just in the process of waiting for the final interview to be able to officially go to the US. The problem is during the waiting process, the two grew apart and realize that they are not compatible with each other. They really regret going through the marriage and are in a state of confusion. What are their options of what they can do? Do they have to file divorce papers in Vietnam (since the wife haven't officially gone to the US yet)? If they do get a divorce will it be difficult for both of them to remarry in the future?

Simply file a divorce in Vietnam. Either one or both should notify the consulate that they no longer wish to proceed with spouse visa, so the case will be closed.

If the USC wants to marry someone else in less than 2 years, he should have immigration attorney handle the case.
