View Full Version : Lien or judgement for work not paid for.

I was contracted by a landscape co. to do some irrigation work. I was told by the owner of landscape co. when the work was done I would be paid. The work was done, After sumitting a bill, waiting for 2 weeks, making several calls, trips to the office, experiencing heating conversations with this indiviual I was only paid for the material. The owner did send a letter to me stating that when he got paid for the job he would finish paying me. I still have not been paid and it has been 3 months. Should I file a lien on the property or do I have to file a suit in small claims and get a judgement first? This is in Cherokee county, GA. Oh is there a time factor 60 day etc in which I have to file?

Hello contractor:

You probably have a year... But, of course, you don't want to wait that long. You can probably file a mechanics lien, but that's not going to get you your money right now.

I'd sue him. If he's just behind, that might prompt him to put you at the top of his list. But, if he's going to stiff you, better now than later.

Once you win a judgment, collecting on it may prove problematic too. But, if you get that far and still haven't been paid, come on back and see us.
