Does the father of my children have rights to them if he didn't sign the birth certificate and refuses to pay chodsupport? Can I take him to court to have his rights taken away if he has any?

Well there is a connundrum here. If he's not on the birth certificate he has no rights. If he wants rights then he would have to go to court to have himself declared the legal father.

On the other hand, if he's not on the B/C he has no obligations either. So he doesn't have to pay any support. To force him to pay support you would have to take him to court. Part of that process would be to have him declared the legal father which would involve a paternity test.

So you can't have it both ways.

He was proven to be the father by doing a DNA test in 2007 and is court ordered to pay childsupport but does not pay because he can't hold a job and stay out of jail. I want to take him to court to have his rights taken away from him. Can it be done?

What's rights does he have ? And you have to say he abused you

I don't know that he has any rights to my daughters but if he does how do I go by getting them taken from him. He refuses to sign them away. And NO he hasn't ever hit me but he has a bad mouth on him.

No he has never abused me but he has a bad mouth on him. If I could prove him unfit if we went to court, could his rights be taken then?

I doubt he'd lose all of his rights - they'd send him to anger management. Bad language is not a reason to deny his parental rights.

If you can prove he's a danger to the child, yes, visitation would be suspended or supervised but you have to prove he's a danger.

I think Scottgem pretty much covered the various scenarios. I don't remember - is he paying support?
