View Full Version : How do I get a Legal Joint Custody on my son?

I just have a question and hoping to get an answer from someone who can understand.

I gave birth when I was 19 yrs. Old to my son who is now 7 yrs of age. When he turned 1 yrs. Old I asked his father to take care of him while I go to school to get a good job. His father and I were never married. We never went to court for anything about an agreement regarding our son. My son is still living with the father. I tried to do everything for my son and now that I am married his father is giving me a hard time about taking him back.

I'm moving to Washington state in a week and I'm afraid that I won't see my son as much anymore. His father is worried that I will take him away which is not the truth. I will never take him away from him.

You go to court and get an order then he has to follow it.
The Judge may favor the father more if you have not been visiting and helping to raise him. Also my daughters bf's mother is having a hard time getting custody of her daughter because she moved out of state and the Judge seems to be using it against her saying 'she only moved out of state because she thought it would work more in her favor for custody.
You really aren't going to get anywhere without going to court though.

It's taken seven years for you to figure out that you would like custody back? How long have you been out of school? I would be worried if I was the father also, you have not been the primary parent now you are talking about moving and wanting to be more involved. Why are you moving away from your child?
