My ex boyfriend and I have a 3 year old son together and our relationship has recently ended. He is threatening to take my son from me and move to another state. I understand that he cannot take the child from me since we are not or were never married but I do not want my child to have to travel across state lines every weekend. I think this would be too stressful for the child. I do want his father to see his son, but not in another state. We reside in Indiana, if someone could please assist me with this... I would be greatly appreciative!

Is the father on the because? Why would you think that just because you weren't married he can't take the child? He has just as much right to the child as you do. That being said you need to go to court and petition the judge to order you with physical custody and get a support order. The father can then either also file for custody and it will be up to the judge where the child lives or the father can just file for visitation.

If he is threatening to just up and take him make sure he can not get your son. Keep written documents days he threatened and what he said. Keep any emails he sends. If he calls you don't answer and let him leave threats on the answering machine and save them.
When he tries to get your son call the police and let them see/hear the threats.
Go to court and file for full custody. If he tries to get custody you have all the stuff proving he threatened you.
If it looks like he might get visitations try and persuade the court to make it supervised visits.

Another thing is that after custody is decided depending on where you live crossing a state line might not be such a big deal. Your surrounded by states and depending on where you live your probably not that far from a state line. Keep that in mind when you make your visitation / parenting plans.
