View Full Version : No Will - Widowed Mother In Law - House

Hello, We've been taking care of my bed-ridden mother-in-law for 4 years now. My father-in-law has a house that we paid off with his 401k when he passed. To our understanding, the house goes to her automatically. Now it has been 4 years later, and the taxes on the house are paid to date and it's in better condition now then when he left it. We do not live in it, we do not rent it out. What will become of the house? My husband has power of attorney. My husband is the only son. What are our options?

Power of attorney ends at her death, the heirs will get it, if the husband is dead and the son is a only son, he should be able to get it, but it would be easier if there was a will.

Ok, thank you very much for answering so quickly. I forgot to mention that the house is still in his fathers name, not joint.

So it is going to be a probate mess. It will have to go though provate to go into the mothers name, and then to go into sons name.
You really really need a real estate attorney now, first it needs to be moved over into mothers name though probate, and then either a will or perhaps have son added to deed.
