Hi, I was involved in an affair with a woman for about 3 months, and then my wife found out I ended it after I realized how much I hurt her. I begged her to forgive me and she says she forgave me but now she wants to know what her rights are, as far as filing a complaint or taking this woman to court for causing her all this pain and suffering. I know I was part of it so I don't know what will happen if she does go through with it. She's pretty broke down over this and she is taking meds to help her calm down her nerves, she doesn't have any proof of the affair, only that she over heard a conversation between me and this other woman. She said she would not go through with it if it will involve me, but she feels she needs some justice done to this woman. Now this woman has moved out of state and we don't have an address for her except a phone number. I need to know what to expect if she does decide to try to take this woman to court. Or is this even a case where she can only come after me. Can somebody give me some insite on this matter. Thank you

Your wife doesn't not have a case to prove distress against the mistress.

Her pain isn't about the mistress at all, it's about you. Her case has no legal merit.

I agree with Justfair that she has no case against you or your girlfriend. If such matters were able to see a courtroom, then the courts would do nothing all day except rule on dalliances.

Your wife has the same grounds to sue your ex-mistress as she has to sue you. You both knew you were married, you both knew you were cheating, you both pretty much knew (or should have) that she would be devastated. The other woman never made any vows to your wife. You did. That's how the Court is going to see it.

She can't do anything to the other woman; she can divorce you.

She can take the woman to Court if she wants to, spend the time and money, argue alienation of affection. If she decides to divorce you she can attempt to drag the other woman in as grounds (which her Attorney will discourage) to embarrass the other woman. She can tell everyone she sees that you are both cheaters.

That's about it.
