View Full Version : Sister is a drug free loader will not get out of house

Our Mom passed away Sep.47 yr old sister has been nothing but a child all her life.she terrorized our Mom all our life.
She has physically emotionally abused her.told her over and over to kick her out.
Now she passed away.and the home she is living in we are both co-owners according to the will.
We are going to court I am the execution of the estate.
She can not hold down a job and needs mental help.want her to move out so we can sell home so she can have money to live on and get help.and I do not want to take care of were my mother never fixed.
I have paid her 700.00 dollars a month for 3 months and paid utilities. Told her to get a job but no.the way she is looks talks no one would hire her.if I talk to her she has no reason,and she screams and rages.I have to hang the phone down or leave.

How can I sell this house and get ride of her?

If you are the executor, you have the legal authority to sell the house. It's important to determine if your mother's will specifies that you are to each get half of the house or if the house is simply an asset she owned when she died in which case all your sister is entitled to is the money from the sale of the house, not the house itself, minus her share of the fees you need to pay for taxes and legal fees.
You have my deep sympathy, I have relatives exactly like this and can understand. Really at age 47 she is not likely to change the habits of a lifetime. And that is worse to have to put up with because you are also greiving for your mom. I would suggest you contact a lawyer, you would still be executor but they can guide you, also any contact from your sister would be through the lawyer, you would have witnesses to any outrageous conduct on her part. Mostly I would advise you to get through this, then change your phone number, address etc. so your good for nothing relative cannot locate you to sponge off.

You are co-owners by Will. In order to change that you need a Court Order or her consent. The Court handling the Estate will be able to advise you but you may very well need another Attorney to prepare Motion papers to force the sale.
