My father and I are both tenants on a lease for a home with a month to month contract. I tried to call the owner several times to discuss with him that we would be moving out. He never returned any of my calls. I finally sent him an email on November 3rd telling him I really need to talk to him in regards to us moving out and giving our notice. He still did not respond to that so I then called again and left a message. He then sent me an email telling me he really did not know what to say to me or how to respond and basically begged us to stay in the house for at least a few more months. I replied by telling him that the house we were moving into was ready now and that since I had been trying to get a hold of him since the 3rd of November our last day would be November 30th. He then sent me a certified letter saying that I gave my notice but my father did not give his so he is obligated to stay until he gives his thirty day notice as well. Is it required that the notice that we give be signed by both of us? If not can you direct me as to where I can find that in writing. I even had people come by that were willing to rent the house as of December 1st. When they contacted him with interest all he did was to tell them all about us and how we did not give a written notice to them. He basically gave up the potential to rent the house and not lose any money in the deal. Please help, I don't know what to do. I am out and would like to give him the keys by the 3rd of December, which would be the official date of 30 days from my first email... Thanks, Michelle
