Ny daughter has been arressed for a crime she did not do, Mother-in-law accused her of stealing over 10k worth of jewlry and she doesn't even have any, just to have her son get custody of there child. He won, she was arrested and he has custody of child. Public Defender is not doing his job, I think there is some buying off her, paying off in other words. But I can't prove it, her case is Wed the 3rd and she is going to jail for something she didn't do, How can I get another public defender and the case posponed until I get on, or what do I do, Desperatly need help. Can I fire the public defender or what.

I need to know how to fire a public defender that I believe has been bought off. He is not doing the job he needs to do for my daughter, A lot is wrong and my daughter is facing a felony charge, and on Wed will go to jail, because public defender is not doing his job, a custody case turns into a felony charge, stealing 10k worth of jewlry and the women is on welfare. How can I fire him and can I do it with no attorney to represent her. A felony rap will ruin her job, her education, as well as voting, and having a chance of life a descent life, Please I beg someone help me. Thank you for all that answered to me. First of all, the trail date isn't until Wed, she hasn't been found quilty yet, however the public attorney recommended that she take the plea bargin. As to the case being a custody case to a felony. It is because my daughter took her baby over to see the other grandmother and to the father to see there child and grandchild for the first time, After she left there house, a couple of days later there was a knock on the door and it was the police coming to arrest my daughter for stealing 10K worth of jewlry, Then the next morning the father was awarded custody of the child, because my daughter was in jail waiting of me to post bail. I am saying all this was a set up so that they could have my daughter arrested and while they were processing her and getting her bail set, they went to the courts and told them the mother was incarserated and the father was awarded temp guardingship of the child, even thou that was the first time they had even seen the child, so after they accused her of the theft to get her in jail long enough to get to court and get the child, they can't stop now. But we have evidence that she is lying and the public defender won't look into it, and we can't get the proof because of the law that protest our privacy. I said the welfare bit, because she gets food stamps and has been on SSI for years, she can't afford 10K worth of anything. Also in order to get food stamps in the state of Delaware, they make you sign a form saying you have nothing of value, and she did, so she either lied on the food stamp app or she lied to the police, and nothing is being investigated. That is where the welfare came into this. I no this women and anyone that knows her knows that she has nothing of value. I would think that if she says she has all this jewlry then why didn't they get her to prove that she owned it, by receipts or insurance. I would have insurance if I owned that much, and if she had home owners insureance, wouldn't she have to list these as well. I am just so scared because as she told me she knows people in high places and she gets what she wants.

Your daughter must ask the judge for another PD. You cannot do this for her as you are just a spectator in the proceedings.

I don't understand how a custody case could turn into a felony. What does stealing $10,000 and being on welfare have to do with anything?

And there are a lot of women incarcerated with children on the outside so that argument is not going to fly with the Judge.

First how old is the girl, since if she is over 18 she has to fire them not you. And they may still have to ask for it anyway.

You are free to hire them a new one.

Also I doubt they are paid off, all the PD normally does is to review the paper work to be sure everything filed is legal. None of them play the TV roles and actually investigate. They don't have that sort of budgets or time. Most never even visit with the person till before trial and merely sit though trial to see that everything is legal or try to work out a plea agreement.

It is the evidence, they have to prove the case with evidence in court.

But if there court is over and they are going to sentence next week, I am not sure there is anything you can do if there is already a verdict.

And if the judge believes you are only stalling he may not allow it.
But they will most likely just appoint a new public defender ( someone out of the same office,) who will just show up at the new court date and meet with them a few minutes before the trial starts.

Evidence is not what you think, or what most people would do, and "everyone" knowing is not evidence. Her being on food stamps is not evidence.

You will find that most of what you mentioned could not be used in court to start with.

In the end, they are suppose to prove she did it,

On the second public defender, remember this will just be a buddy of the one you are firing,
