View Full Version : How do I levy a bank account?

I have a judgement against someone who lives in New Jersey. The judgment was awarded in Delaware. I know where this person lives and where he banks. He also just bought a car (paid in full). What is the process for levying his bank account and forcing him to sell his car? The judgement is for $4,000.00. I know this peron has most of the money now.

Do you know where the debtor is employed? A wage garnishment would be the easiest way.

If not, you can file to have his bank account "frozen" and have the money taken out of there, but you can't force him to sell his car.

You go back to the court that issued the judgement with the information about assets. You apply for a writ of attachment of those assets. You then get a process server to serve the writ on the bank. It you want to seize the car you may have to get a repo specialist to do that. But you have to get an order from the court authorizing the seizure.
