View Full Version : Mom Never got hearing date/will go to jail child support

]I will bet you have never heard a true tale like this before.....
I was a battered wife- I left him
He waited until I was in nursing school and helps me by taking our son to school everyday.
Turns around and gets de facto full custody of our son! He never paid me a cent for 5 years...ever for that matter. I start getting a bill from child support....no hearing date...they held that without my knowledge, they said they served me but I proved they didn't.
A couple of years later he gets tired of being Dad and I get my son back.
Last year I get 11 charges on me for not complying with a court order, I can go to jail for 2 months!! I gave proof that I never got a hearing date for child support proceeds(neither did my attorney) but they said it doesn't matter.
I provided the DA with a sworn statement from my son(14 now) that he has been with me since 2005.....they say it doesn't matter!!
I am disabled and unable to work.....doesn't matter.
What am I to do? I am supposed to pay $6,000 of my EXs arrears too on top of my $12,000.00 !!
If anyone can help me ...my court date is [/I][/B]Dec.08, 2008 HELP!!

Were you or your Attorney served with a copy of the Order of Support?

Your Attorney is far more familiar with the law in your State and the specific circumstances of this matter and the rest of us are pretty much citing the Law as we know it and guessing at the missing information.

I'm a little confused about the Court Orders - as your son went from house to house were there new Orders issued? An Order remains in effect, despite changed circumstances, until you go into Court and change it. This is posted all the time - there's a support Order, the other parent takes custody, there is no change in the original order, the second parent (with custody) stops paying, the original custodial parent sues.
