My ex-boyfriend and I took a trip together back in August. I paid for the accommodations with a check in the amount of $1850, which he said he would reimburse me for his half. We recently broke up and I still have not received the money ($925). We were also sharing a cell phone plan, which he owes me $440 for. I have called him, written him a letter, and even had my father call him for the money. He won't respond. I want to take him to small claims court to recoup my loss. I am a single mother of two small children and need that money to pay bills! He owes me a total of about $1300. I also found out that he got engaged two weeks after we broke up! Therefore, if he has the money to buy a 1.25 caret ring for her, then he should be able to pay me back for what he owes me! How should I get the money out of him? Should I take him to small claims court? I have evidence we were on the trip and the canceled check, just nothing in writing... I also have evidence that he was on my cell phone plan. I do have a few of his belongings, and he has some of mine that I would like to have back... I just can't get a response!

You would file in Small Claims Court, present your evidence (what he said, what you said, any witnesses, receipts) and he will present his evidence and the Judge will rule. Ask for what he owes you and the return of your belongings.

He will argue that the trip is a gift and you will argue that it was not. Oral agreements are legal, by the way, if there is an understanding of the terms of the oral agreement by both of you and you both benefit from the agreement. In this case, you had company on the trip and he got the trip.

I would stay away from the girlfriend and the 1.25 carat ring because it makes it sound like you are now attempting to collect out of jealousy or spite.

The easy part may be getting the Judgment; the harder part is collecting it if he won't pay willingly because you will have to find a means to collect - from his wages, his bank account, whatever is legal in your State.

I would also not have anyone else calling him in an attempt to collect, including your father.

My ex boyfriend wants to evict me and our 2 year old out of the house for hich we are both on title but he is the only one on the loan. I have prove that I made the downpayment any other payment thereafter.

And your question is can he evict you? No. You are on the title.

You should sue him for child support (assuming that the 2-year old is his child as well as yours) and custody. You can also sue him for partition concerning the house.
