Need advice, I purchased a Rv from a company and traded my old one in, they never paid the balance of the trade in off, at the same time they filed bankrupty, and are now pending a criminal investigation for screwing the banks out of up to 4 million dollars, so I was called by the finance company and told I was behind on my payment... well now I have 2 RV's I am paying on... I have filed a complaint with the atty gen. What I want to know is they signed the title and also stated on the paperwork for the new one they were responsible for any existing money due on trade in... so shouldn't the trade in be added to their bankruptcy, and be out of my hands... hope someone can understand this...

Hello Raza:

They never assumed your loan. They SAID they were going to pay it off, but they didn't. Looks to me like you're the one who's going to be responsible for paying. If you sue them in small claims court, it probably WILL get added to their bankruptcy. But, I doubt that'll get you anything.
