I just received a letter from LVNV Funding, LLC stating that I owe a bill to MCI Communications. The account has not been touched in 6 years. They are threatening to sue if I don't pay in full or make a settlement. I live in New York State. Am I still responsible for this bill? I am trying to improve my credit and worked very hard to get it over 700. I know that taking a settlement will hurt my rating. Should I just let it go or should I contact them? Should I arrange to make payments, take the settlement or just forget the letter?

If it's a valid bill, yes.

Having a delinquent account will hurt worse.

SOL for this would be covered under the UCC SOL of 4 years. Their threats of suit on a time-barred debt are a violation of the FDCPA.

Not all states follow the UCC. SOLs on contractual debt vary.

NY has adopted the UCC into state statute. Regardless, if it's been 6 years since the account went into default, this debt is still time-barred. It may not stop them from filing and obtaining a default judgement if the OP does not respond though.

Whoops, sorry, I didn't see the OP had mentioned he's in NYS.
