My Ex- husband owes about $10,000.00 in back child support. He recently informed me that they froze his bank account. We currently have a court order for him to pay a certain amount in addition to an extra $50.00 to be applied to the arrear balance. He has been current for the past year. I have had to take him to court on numerous occasions for failure to pay. He recently was fired from his job and it has been about three weeks since I have received a payment. He told me about his bank account has been frozen and it does not make any sense that they would freeze his account all of a sudden. Is it possible to do that if he had a lot of money in there for whatever reason and they found about it? Ex. Maybe he received a settlement or something. They have never frozen his accounts before and he went over a year without paying. My other question is I read online that they can freeze it for up to twice the amount that is owed, which he told me that the amount has doubled and it is over $20,000.00. I appreciate any answer you can give me .

What state are you in and how long has he owed arrears ? Some of what your saying doesn't make sense so we really need to know the state it is happening in. And no they don't actually monitor his account then seize it when funds are there. That would be illegal. Its mostly a crap shoot. A lot of child support service workers regularly overstep their boundries and all they have to say for it is oops. So I wouldn't count on anything until its already in your hands.

I am in New York State. He has owed the arrears since 2002, but he has been paying on it regularly this past year. When we went to court he was instucted to pay it along with the arrear payment

You may need to go back to Family Court and ask to speak to someone to assist you with a Petition (Violation of Support Order).
