MY brother rented a room in a house that I own in California, it was a month to month, and he took a security deposit of 300.(but he didn't have sign a contract), she called me and I told that we were to give a 30days notice if we wanted her out and she was to give a 30days to move out.During the second month she text message around the 19th of the month that she found a job in another state and that she wants her money(deposit) she will be out in 2 weeks.I told her that she isn't entilted to her full deposit or even all her deposit but I would give part back. Now she a guy she just meet in another state calling me and asking me for her deposit.Could you help.She also borrowed 100 dollars from my 20 year. That she didn't pay back.

Are you asking what's legal or what's ethical? In NJ, without a contract, or something in writing stating that you both agreed to 30 days notice, your SOL and she can sue you for the deposit if she has it in writing that she gave a refundable deposit.

Ethically, she should pay for 30days rent after notice is given, but you might give her the opportunity to find a sutible tenant to replace her , in which case, if there is no interruption of rent for you, I think you should return the deposit.

And sign a lease next time!

I'm a little confused here. You own the house, but your brother rented a room in this house to some woman.

Was the brother entitled to do so? Was he renting the house from you? How long did this woman stay there? Did you pay all her rent? Why did you want her out?
