View Full Version : Who has the right to build on my property?

Hi may name is hannsi. 20 years ago I bought a land in PA. we were going to built and move,but we decided not. 2 months ago I decided to sell it, so I put it on the market,3 wwekes ago I got a buyer. Now the deed say that a construction company has the only right to build in that piece of land no one else. So if I want them to give up the rights I will have to pay the so they will release it. The first week it was $2700, then they say not now is $3000 then went up to $4000 and today they call me 4 times to tell me if I don't make the payment by Friday, next week I will have to pay $7000.
Everything is so weird they don't want checks, ONLY CASH WILL BE ACCEPTED he tell me every time he call me. The thing that nobody told me anything 20 years ago even when the real state agency knew that my husband has a construction company and we were planning to build our own house. I don't know what to do? Do the have the right to take 20% of my poperty just for release the right to decide who will build in my property??

The whole thing sounds very shady. Especially the cash only part. And the weekly escalation in price. Contact the town government immediately. If they can not help you then contact an attorney.

I agree. I don't know the laws in PA, especially 20 years ago, but in NJ it is common (not sure if required) to get title insurance to avoid something like this. If you had title insurance (today it would be listed on your HUD 1 form, not sure about 20 yrs ago) they could be held liable. Attorneys fees for this should be under $1,000 total - and they usually offer a free consultation. I'd call a local attorney and go meet with them, see what they can do.

Did the title search reveal this information?

DO NOT give them a dime until you see a lawyer, and NO NOT give them cash. What they are asking & doing sounds illegal.
