You can't just file papers to have him sign over his rights. If your husband of at least one year wants to adopt then you have to hire a lawyer. They will draw up the papers and the bio father will be able to choose to sign to allow the adoption or not to allow. You can go back to court to have the support order enforced in the mean time.

Ok, his not visiting and his not paying on time is not a reason to take his rights away ( anyway a reason the court will accept)

But if you have a husband who wants to adopt, you hire an attorney who will do the adoption paper work and ask the bio father to sig them over to allow the adoption
