Hi All,

I am from India, I came to USA in August first week 2008 so for 2008 Year I would be staying for less than 183 Days in US. I am working for TCS and my Employer is deducting the tax.Can any body help me to know how much tax return I would be getting once I file Tax return, I have heard that I may get total tax return that I have paid. How tax refund is calculated. And one more thing do I need to pay tax again in India for the money earned in US.

Thanks in advance for the help. Hoping to get detailed answer.

Your visa type? If you came is August 2008, you will be non-resident for 2008. You will file non-resident tax return in the U.S.
Your U.S. income is subject to SS tax at 6.2%, Medicare at 1.45%, federal income tax, state income tax, and other state taxes (if any).

We also need to know:

1) HOW MUCH income you earned while in the U.S.

2) How long you will be in the U.S. in 2009.

3) Your marital status.

Assuming you have work visa. You will file non-resident tax return.
On income of $16,000 for 2008, your taxes are:
SS tax $992
Medicare Tax $232
Federal Income Tax $1474 (or less if you claim itemized deduction for state income tax)
Plus state income tax.
Your taxes withheld can not be $7000.

MukatA:

I believe his total income was $23,000; the $16,000 figure is after taxes were withheld.

Hence, his Social Security was $1,426 and his Medicare was $334.

That leaves $5,240. If he lives in Massachusetts or California, his state tax withholding can EASILY be over $1,250, which means his federal withholding is around $4,000.

If he claims SINGLE with ZERO exemptions, a $4,000 withholding is very possible, especially since his tax liability will be in the $2,300 range, because he CANNOT claim the $3,450 standard deduction.
