View Full Version : How do I get my son in my custody?

I am 19 years old, I got my ex preggos and am expecting march 28. I am way excited but way concerned at the same time. Since she's been pregnant and we broke up she has yet to quit smoking(cigarettes), constantly going out to parties w/ her so called "new friends". Went to one to many got slipped some date/rape and yeah it pretty much explains it self. And ever since she had her night, every time we talk she just says how much a POS I am, etc. just trying to make herself feel better but then she goesand says I have no rights to my son, he's going to have her last name, I won't be able to be involved, and so on... anyway rambling over what rights as a FATHER do I have for my son??

This question has been answered many times in many forms. To sum it up: when the baby is born, you petition the court to establish paternity. Once they determine that you are the father, you file for custody/visitation and support. After that, you have as much right to your child.

You also have as much responsibility for the little one.

As pointed out, generally you can do nothing until the child is born. But this is an extreme situation. If you can prove that the mother is endangering the fetus by smoking, drinking and taking drugs, you may be able to file a "friend of the court" motion to have her institutionalized: to prevent harm to the fetus.

I would consult an attorney or social services about this.
