I am on a three year J-1 visa. For 2006 and 2007 tax years, I filed form 1040 NR. What tax form will I file for my 2008 taxes?

Anthony:

What is your home country? This is critical, because, normally, a person on a J-1 visa becomes a resident alien in the third year.

However, the tax treaty (if any) between the U.S. and your home country may authorize a THIRD year on non-resident alien status. I believe the Chinese tax treaty does this, as does a few other countries.

I cannot properly answer your question until I know your country of origin.
