We just had a fire in Kagel Canyon Calif. And had to be evacuated for a couple of days. I have a guest house and now my tenant wants to pro-rate 4 days because we did not have electricity or could not come back. Is he correct?

Probably not.

Do you have a written lease with him? Refeer to that, and then your state's landlord / tenant law... there's a "sticky" at the top of this forum with a link to each state.

If the electricity gets shut off because you don't pay the bill - that's one thing. But for something like this, it's beyond your control. You can check your insurance - it's possible that you have coverage for such things. Was there any damage that you'll be claiming?

The issue is, if he doesn't pay you for those days you'll have to evict him or sue him and then try to collect if you get a judgement. If he's a good tenant otherwise, it might be worth considering. Or if he's a persnickity kind of guy it might just set a precedent for him to start nit-picking everything.?
