View Full Version : Does a annual lease automatically renew as month to month?

I live in a mobile home (over 55) park in Ocala FL. We lease the lot only Jan 1 through Dec 31 for 2008. The lease reads that it renews automatically on Jan 1 each year and the managers say if we stay one day in the new year we are on the hook for the complete year. Is this true without signing a new lease or does it roll over into the new year as a month to month tenancy?

I believe that would depend where you live. And the exact wording of your current lease. Your landlord could potentially be correct. I'd call your local housing authority to find out if there is validity in what your landlord is saying.

A couple of things...
First, the lease should state how it works. You said that it says that it renews automatically, but does it not say renews for the full term. Or renews on a month to month basis, or any more specifics?
Second, review your state's landlord / tennat law. There's a "sticky" at the top of this forum with a link for each state. Just make sure that you're reading the right law - I believe most states have separate property code for mobile homes than for residential real estate.
