Today I received a eviction letter and I need to know what to do. How much time do I have ? Should I talk to my property manager ? Im at a loss:confused:

I owe back rent I really don't have that much its 3 months as of tomorrow... I do want to get out but I really want to know how much time I have, I have kids and I am embarrassed I don't want them to find out I want to try to keep some dignatity

Was the letter from your landlord or from the court? If the letter was from your landlord then it will say that you have a certain number of days to either pay all of the rent that's due or move out. Usually it's 3, 5, 7 or 10 days. If you don't pay within that time and haven't moved out then the landlord has to file a lawsuit for eviction. Once the lawsuit gets filed it can take anywhere from 2 weeks to 2 months for a trial to be scheduled. If you haven't paid as of the trial date then the landlord will win a judgment for eviction. Then the eviction gets performed by the constable or sheriff, usually within 1 to 3 weeks.

If the letter you received was from the court, then it is either a notice that a trial has been scheduled, or it's a notice that there was already a trial and the landlord won a judgment for eviction. If it's a trial notice then you will have at least until the trial date to pay or move out. If it's a notice of judgment then it should state how many days you have before the eviction is performed.

It's a notice from the small claims court that an unlawful detainer complaint (eviction action) has been filed naming the above party(s) The couts file, index, register of actions, or other records will be restricted during the first 60 days from filing of the compaint.

This is what the letter starts with...

No, you won't be locked out. This is a notice that your landlord has filed a lawsuit for eviction. It should also include the court date. If the court date isn't on there then you can call the court and ask them when it will be. You won't be locked out before then. But I suggest that you start making arrangements to move or find a way to pay the back rent.

Seriousy I already planned on looking for a place tomorrow and My parents said they will cosign I am hoping that will work in my favor.

And there is no court date listed anywhere on the letter.

No problem. :) Just call the court on Monday and ask them if a court date has been scheduled yet.

I called the courthouse yesterday and it is not on anylist yet, I talked to my property owner and she says she will keep me up on what is going on... I hope so. I wanted to go and look for an apartment today but omg it poured here... Thanks again for everything you made me feel a lot better...

Don't rely on the property owner to keep you up to date. Call the court once a week to keep checking.

OK, so now just a few min ago I got served a summons but still not a date anywhere, omg I am so confused I need to get out don't I

Yes, you do need to get out. But it doesn't have to be within the next 10 minutes. As I said, keep checking with the court for a court date and keep looking for a new place.
