View Full Version : How will my ex-husband's foreclosure affect my new husband?

My ex-husband was ordered to refinance or sell our marital house in our dissolution decree. He couldn't refinance, so the house has been for sale for almost 9 months without a bite. My ex was late in paying the mortgage twice, and he doesn't have steady employment. I am worried that he may loose the house to foreclosure.

I am now getting married to a man who has a house of his own. My question is this: If the house would go into foreclosure, could they take my new husband's house from him? My name is not and will not ever be on the mortgage or deed of his current house, or any house he purchases after being married.

Your new husband's property has nothing to do with your ex husband.

No, it doesn't matter. The only person who will be affected by a foreclosure are the people listed on the deed and mortgage, which obviously, your new husband is not.
