My name is Shannon and I live in Jacksonville Florida. Recently my roommate moved out and didn't pay her rent. That of course puts us behind. When she had moved in she was replacing another roommate who was falling behind on his rent too. So we were a little behind before she moved in. Now we are still behind but we are making payments at least twice a month to catch up. He is consistently getting money from us but sends threatening e-mails saying he must have the full amount by Friday... which will be two days later... or he will be proceeding forth with evicition. He initially told us he wasn't going to charge us late fees ao we only owed him $1100 but then he tacked fees back on so that made us owing him close to $1500. :(We make payments and told him the roommate left owing money. Can he do this?

Well, what does your lease say?

By him accepting partial payment for rent - he can't really evict you.
I would worry if he stopped accepting your payment.

Yes, the landlord can file for an eviction at any time. Acceptance of partial payment in the past doesn't prevent the landlord from evicting you.

Yes, your issue is that you don't realise if one of the people don't pay the rest of you have to pay more right then, to keep payments up to date.

He can keep adding late fees, and he can evict. So all of you need to chip in and pay all the late bills.
