I recently bought a vehicle private party, and the seller did not have the pink slip or title on hand. She did however apply for a new one but will not send it to me. I want to return the car to her since I cannot register it without a title or pink slip. By returning the vehicle to her, am I entitled to anything as far a my money back or what?:mad::confused:

What has the seller told you, are they willing to give you the money back?

If they don't, you will have to sue them for the value of the car.

** note, if they don't have a title, don't pay the car.

First the person told me that if for some reason the car did not work out, I could return and $1000 would be given back to me. And now that they are not giving me the proper paperwork to register the vehicle, the person is telling me that I will get no money back if returned, even though it is reqiured my DMV law to provide this paperwork to me, the buyer. What can I do about this situation?

I assume you got a receipt/have your cancelled check showing you bought the vehicle? Send the previous owner a certified letter, which requires their signature, stating that they can either a) send you the title with their signature showing they sold the vehicle to you or b) return your money in full; inform them that if they refuse to do either, you will file a lawsuit against them for the money you paid for the vehicle.

And as Fr_Chuck already mentioned, never buy something that someone doesn't have paperwork for.

If you have proof that you purchased the vehicle (Bill of Sale) you can take that to the DMV and get a new title isued.

Otherwise you will have to sue.

I do have a bill of sale and receipt of the deposit that was left to hold the vehicle. The vehicle is in my possession. Where I live the DMV needs a bill of sale to be notarized in oder to issue a new title. I bought the car from out of state through a friend. But thank you for the information. This does help a lot.
