My baby is due in 4 weeks.I am not with the father and had to quit my job 3 months ago due to pregnancy complications.Right now I live with my mother and she is helping me pay my car payment and credit card bills.My credit cards are maxed out from having to buy things needed for a new baby.The dad has not helped me at all since I've been pregnant,but wants to be in my child's life when she gets here.My mom and I are planning on moving out of state after the baby is born.My mom can't afford to pay her bills and mine,so we have no choice.I have no where else to live but with her.I need to file for full custody, right?How long does that take?And if I file for child support before I move,can he make me stay in the state if I have no where to live here?He can't very well make my mom and me stay here if we can't pay bills and afford to take care of the baby?

As part of the child custody fight in court and as part of the child visit agreement, yes he can ask that you not be allowed to move out of state without his permission.

He can also file for custody and visit the day the child is born if he wants to also.

You would've custody of your child unless he trieds to fight for custody. Even if he doesn't fight for custody he can get visitations with the child and he can be force by the courts to pay child support. Once a order is in place he will have a input to you moving to another state because if you move it can interfer with him seeing the child. You should bring it up when this day come because maybe an agreement can be made about visitations to the child if you was to move to another state.
