View Full Version : When would I get assigned a public defender

I was arrested and they let me post bail without going to jail at the end of Aug. for embezzlement of $3,000.00 which is a felony. I live in a small town and on Sept. 2 they had to transfer it to another town that isn't much larger but they have the courthouse for the county and I have not heard anything. The police said I did not have to attend that court date on sept. 2nd. Also, I called right after it happened to see about getting a public defender and the district attorneys office said the judge appoints one. My question is when would that happen I have never been in trouble before I don't even have a speeding ticket on my record. I also want to know do you always go to jail or can it be probation and fine??

Stealing 3000 is a lot different than a traffic ticket. First I know in states like Georgia, if you do bail, you can not get a public defender, they assume if you have enough money for bail you can get an attorney, this is normally I am sure there are exceptions. I see you called every one but the public defenders office??

Plus you did not attend the first court date , are you out of your mind?

After you are arrested the police have nothing to do with this what so ever, it is out of their hands and they have no idea if you have to attend or not. That is up to the DA at that point.

I would guess the police lied to you and you may have a warrant out for you now for failure to appear at court.

If you have already paid back the 3000 it will go a lot easier

It wasn't a court date it was a date to transfer the case to our next town because this one is so small it doesn't even have a city hall. I called the district attorneys office because that is whose hands it is in now to go before a grand jury.
