View Full Version : Can my boyfriend have custody of my son

I have had issues with dyfs in the past.I lost custody of my son to his father who has the same issues that ii have had . We used to drink together. I was the only one that got in trouble for my actions we have been back in forth over him not complying with court orders and now I want my son back.my question is if there are issues with my past actions. Being that I have been with my boyfriend for three years,we just bought a house together he has no issues what so ever is it possible that the judge will or could give custody of my son to my boyfriend or he can be responsible for him I live in pa and don't mind if children's services visits my home and monitors us my court date is nov 14 do need to file a motion for this to be heard or will she just hear it on that date my son father has his own issues with dyfs currently please respond

You're boyfriend has no legal standing in the matter. What is the court date for? That will make a huge difference in what the judge will listen to. If you want your child back then you will have to file in court for custody but it will be very hard to get it and your boyfriend won't at all. If for some reason the father also looses custody the judge will have to sign off to let you have the child back but he/she will probably first go to foster care or a grandparent if there is one willing or aunt or uncle that steps forward that is willing.

I'm also wondering what the court date is about.

As Stina said, your boyfriend has no legal standing. No court is going to award custody to a non-relative when a blood relative is available.

So you need to prove to the court that you are a better parent than the father.

Apparently I don't know how to respond I spoke to legal aid and to dyfs and all three of you are telling me something different so ill just wait to speak to the judge

You don't say what the others told you. I know that what I said about your boyfriend having no legal standing is correct.

You really need to pay attention to what's being told you. We told you that help is provided through this site and you responded by e-mail. You then used the comments feature inappropriately. It's a good idea to browse around and get the lay of the land before using a site like this.
