Hi,
I bought a car from small dealer and paid in cash. He did not give me the title yet. The only thing I have is Bill of Sale signed by him. He never answers the phones and whenever I go there he has millions of reasons…
I already told him that I would sue him if he does not give me the title and his response was “I will tell the judge that you did not pay, you paid in cash and there is nothing you can proof.”
My question is, if I sue him in small claims, can I get my money back.

Your bill of sale should show it paid? Your receipt where you paid.

Contact the license department with the state, all car dealers have to be licensed by the state.
** and having clear title before they sell is normally one of the rules.

Now how long has it been ?

A Bill of Sale is generally a receipt for payment. Go to your local DMV and see if they will issue a new title based on the Bill of Sale.
