View Full Version : Filing for child custody, what if father does NOT respond?

My husband and I are separated for just a few weeks. We have a 6 week old daughter. I have filed for sole legal and physical custody, and the papers say that he has 30 days to respond once he has been served. What does he have to do to legally respond, and what if he does NOT respond within 30 days? Also, he is living with another female, but will not voluntarily give me her address. If I get her address and serve the papers to him at her address, what can she do to me legally?

Ok no, we can find almost anyone's address on here, there are 100's of data bases that tell things like that. Also where does he work, just list that address and have him served at work.
If he does not respond normaly the judge will say you win and give you what you asked for.

Why are you filing for sole custody both legal and physical ? Also what state are you in ?

I am in North Carolina. I filed for sole legal and physical custody because the choices on the civil summons were sole or shared legal custody and sole or shared physical custody. I don't want him to have shared custody of any type so I chose sole legal and physical custody. I still would like to know if there is anything that the other woman can do to me if I serve him at her house. I have the address and proof that he lives there, but he is just not admitting to me that he lives there. Can she get me for stalking or harassment or anything like that if I serve him the papers at her house?

YOU cannot serve papers. They have to be served by a licensed process server.
