View Full Version : Family cemetery on privite property?

Our family had a farm in the family for several generations. On that farms property is a family cemetery. After my uncle passed away, he willed it to a cousin. This cousin doent like any other member of the family, and says that it is privite property and that if any one attemps to visit the cemetery they will be arrested for tresspass. Is this family cemetery exempt from this possiability or is there special laws governing this issues? Thank you , rick

You should contact a lawyer.
An easement is something that would apply, but that's only b/w neighbours, so unless u live next door, it doesn't really apply to u

Where a private cemetery was surrounded by private property, and the owner said "no tresspassing". Family members are allowed to visit, during reasonable hours, no matter what the landowner says.
You might check with a lawyer in your particular area, and get some Professional advice.

Apologize to the uncle. Make things right between the two of you, so that you can come and maintain the graves.

Apologize for what... for not being liked??
If the property belongs to the uncle and he does NOT allow anyone to visit, then that is it... no amount of cuddling, apologizing or 'tushy kissing' will work.
