View Full Version : Father in prison and I want him to give up rights what to do?

I separated from old boyfriend when our son was 3 months old, he hit rock bottom after this break up. He does some crazy things that lead him to prison for 14 years he has never done anything for my son and I had met someone when my son was 6 months old and have been with him for 6 years and now engaged. We now have a 2 month old and eventually we want him to adopt my first. My first had always called him dad and so will this one we have been family and when the bio dad gets out of prison I don't want him ruining are good thing so I want to nip it in the bud NOW!!
I HAVE NO CONTACT WITH THE FATHER IN PRISON WHAT TO DO??

First you have to get married. Most states require that you be married for at least one year before they will even consider an adoption. So get that done first then get an adoption attorney also a requirement for all adoptions. Once that happens the attorney will send the father a letter asking him to voluntarily relinquish his rights to allow the adoption. If he won't sign it then you go to court and petition the judge to allow the adoption based on the fact that the father is a danger to the child and your husband wants to adopt.
