We were never married and he has openly admitted to myself, my family, and even his family that he does NOT want to be a father to our son. He has not paid a dime of ANY kind of support and even though he is in the ARMY, he comes home every 3-6 months and only sees him on christmas and his birthday (2 days out of the year), he is present but avoids our son. I also have screen shots of his myspace and post from even his friends stating that he deserted our son. Can any computer screen shots be used?

I mean, why this is so important is because he said over the phone that he would do ANYTHING to ensure that he has no responcibility over our son and that when he wants to, he can still use his rights to our son whenever he wants.

I'm sorry but I take that as a threat and don't think that he should have right or even be NEAR my child. Since the threat was over the phone all I have to show is things typed out on myspace and AIM.

Also, isn't when a parent (even if they are present) avoids the child, and neglets to give the child support, love, and attention under constructive abandonment? I think it is but I'm not sure.

Did you go to court to get an order for support? If not the he dosen't have to pay anything you will need to go to court to get the support order you can also file for full physical custody. But you aren't going to have his rights taken away or anything to do with abandonment.

So you are not married, there is no reason to have to prove that he abandaned you for any divorce. And this is not criminal since he did not leave the child on the side of the road.

Why in heavens name have you not went to court, got a child custody order and a child support order. With him in the army it is easy, they take it out of his check and send it to you.

So get an attorney and stop worring about what he wants or likes, sounds like he has you trained to listen to him

Is this man on the birth certificate ? Did you get a judgement of support against him already ? Has he been established as the legal father ?
