View Full Version : Backyard neighbor says my dog bit her dog

My neighbor came over and presented me with a vet bill for 750.00 saying that my dog bit her dog over the fence on the ear and that she saw it happen. My dog did not leave my yard at any time. Her dog has been known to jump the fence and she has an electric fence about 4 ft from the wood fence to prevent her dog from jumping over. She said her electric fence was not on and my dog jumped up and bit her dog on the ear. She asked me to pay for it. My dog would never bite another dog. Her husband called me and said he was going to take me to small claims court. I said OK because I don't think my dog bit her dog. Something else must have happened to the dogs ear.

She has to have a witness if she wants to go as far as presenting you with a bill and threatening small claims court.

1. did she ever tell you about it when it happened ?
2. so bacicly you say no I won't pay, let her sue you. You go in and tell your side of the story, and she will tell hers, perhaps take photos of fense and so on.

Absolutely - Small Claims comes down to which side is most believable.
As far as your dog never biting another dog, I don't think you can necessarily predict what any dog is going to do.
So I would gather my proof and wait to be sued. The Vet's statement/bill should indicate what type of damage it was and possibly what caused it - animal bites are very different from other injuries.
And I'd tell the husband to stop threatening you.
