My son had a learners permit and is getting sued, accident was his fault. Car and insurance was in his name. Can I be sued also?

Depends on the State and its laws - also depends on whether parental supervision was an issue and whether your State allows the injured party to move against other auto insurance in the same house.

I spend a great deal of time taking down license plate numbers and searching out other insurance.

If he is a minor, while they may not sue you, they may of course merely hold you as the parent liable for the debts, damages and money owed.

Is he being sued because insurance company is not paying ? Is insurance company aware he is being used.

My question would be whether the other people have filed a claim with the insurance company OR filed a lawsuit.

It's my experience that people confuse the two all the time.
