I want to marry my partner however he was a resident but was deported for being in jail for a yr because he had just turned 18 or else the courts would have probably sent him to juvenile courts. He was a resident but because he had just turned 18 and didn't have enough money to get a lawyer he was deported. His crime was a minor crime. It did not have anything to do with killing, drugs or anything like that.
He crossed the border illegally. Yet, we want to get married. Yet, if we get married in the states that would signal that he is here illegally and would hurt any changes of getting a pardon from the U.S. He has been here around 10 yrs now and has not committed any crimes at all. He has never been stopped by the police or anything. Has not even stolen a piece of gum from a store or anything. Straight as can be.

I was thinking if I could could go to his country where he was deported his original country and get married over there while he is here. I think I would get in trouble if I would attempt this and get caught. However, by us doing this after we would get the marriage license we can put in the papers for a pardon which would take about 2 yrs I believe. The marrriage license would be "evidence" that he was "over there" in his country.

Please help I don't know what to do.

Ok as for as a pardon,? Don't count on it, the governor of the state would have to sign it off.

He may try to get the record explunged, but for immigration they will still see it on the record.

Also no getting married does not make him legal, only married.

Most likely he would have to return to his own nation and apply for a visa to come back to the US.

If you did not care about living in his country, you contact that embassy and see what you needed to move there for now.

First of all, you need to understand the facts about this case;

The term "crime" does not mean killing or stealing only. It covers a wide range... and the reason he was in jail is he committed a crime. One year term for the one whose age is between adult and juvenile is not a "minor crime". He must have done something quite serious.

The fact that he has lived in US for 10 years does not make any different. If he entered US illegally (without inspection), there is nothing he can do to obtain citizenship without leaving the country.

Forget the chance to get amnesty, that won't happen. The only possibility is you go to his country, marry him, return to US alone, and file an immigrant visa for him. This is a very difficult case for both sides... yourself, and your attorney.

You must be able to prove that your earning is more than 125% of poverty guidelines. You must never receive welfare of any kind. He must disclose all criminal record to USCIS (expungment can be done but it doesn't help with immigration, plus it's expensive), etc. This is a long and costly process. You would need at least $20K for attorney fees plus $3K application fees, etc. and most of all, it's not 100% guaranteed.

I don't think it's worth going through all the troubles just to marry him. You are too young and inexperienced.. and should not get involve in this mess. Forget the guy... find some decent person.

Can I just go to his central american country by myself and get a lawyer and I sign the papers of marriage and then have them send those papers here and he would sign them. Then he would send them back over there. Would that mean that we would be married just in his country?

If getting a pardon would be impossible at least being officially married even if that means only in his country.

I understand that a marriage license is not a big deal in the 21st century. However, I want to be officially married to him in order to live with him.

I'm not naiive and it may seem as if it is because of his past but he is not even a glimpse of what he use to be. I have been with him for about 4 1/2 years. I have seen his character and it is nothing like the way he use to be when he was 18.

He was in prison because his friend picked him up and in the passenger side. When his friend started driving fast that's when the cops stopped him. That was his first felony but he was in a gang at that time so he had a record of being in trouble a lot. All through high school.

Even if we cannot get a pardoned is their anyway we could just get married even if it means only be legally married in his country without making him go over there??
