I am intersted in getting custody of my niece and nephew. My sister is a disaster. She already has two children that want nothing to do with her. She can't hold down a job, is with a man who refuses to work, has no permanent home and is pregnant again. The children have been living with us for about three months. Her three year old cries every time you tell him he is going with mommy. I am not sure if a court of law will give custody to an aunt and uncle. Both of the parents have a lot to be desired. The are happy and healthy with us. I love these kids and only want the best for them.

A court will definitely give custody to an an aunt and uncle if its warranted. I would first try to get yourself appointed as guardian for the children. That will be easier. You can then move on from there.

It would help if you engage a lawyer familiar with Family Law. They can help you prpepare your case and advise what your local courts will and won't do.
