An employee was overpaid in a paycheck last pay period. They were not informed that they were overpaid. This paycheck the overpay was deducted from their check. They were not informed that this deduction was going to occur.

Should there not be something in writing that states a) the employee was overpaid, and b) the employee be given the option of paying the overpayment back, and c) the employee be made aware that the overpayment was going to be taken back in the next check.

From a PR standpoint, yes. But there is no legal requirements.

Depending on the size of the overpayment I think "morally" the employee should have noticed and the employer should have advised the employee of the overpayment AND the pending deduction, perhaps asked the employee if it should be subtracted from the next paycheck or spread out over the next few.

Legally - no, nothing wrong here.

While no legal requirement, a good HR department would have notified the person of the over payment and informed them that amount was being withheld on the next check.
