My husband's daughter's mother was served with papers over 30 days ago in Alabama but has not responded to the court yet. What happens after Affidavit for Entry of Default and the Request for Commission & Deposition have been filed and court date has been set? This is for child custody.

My research indicates that if she does not appear the Order is entered as proposed - from what I find it's an order of paternity and a support order.
Maybe someone in Alabama will come along -

The Father's name is on the Birth Certificate. In Alabama,he doesn't have to have a paternity. Also the mother has not filed any paper with the courts. There is no orders in place. The Mother and her boyfriend will not let him have anything to do with his daughter. They tell him to forget about her and that she has a new dad the boyfriend.

What is this particular Court proceeding about? Is your husband/boyfriend attempting to see the child and this is for visitation - ?
And many States are exactly that way - if the father is on the because, he's considered to be the biological father. The way the law is phrased on the Alabama site is confusing, at least to me - the papers you asked about appear to address paternity.?
