I placed my unsecured debts with a debt solution company. One of the debtors sent me a summons for court. We were unable to settle prior to court, but once there the lawyer and I agreed on what I can afford to pay. There was not a judge present and I never saw one. Then I received a notice that the company is placing a lien on a property that I have for sale because of the judgment. I'm still not sure that they have a judgment or what the lien means. The house is empty. I got married and moved out two months ago. We placed the house for sale. Now I don't know if I can sell it. We will only get enough out of it to pay off the mortgage. Am I stuck with this house? Can I sell it?

Was it / is it still your homestead? Do you have a homestead exemption on it with the tax office? As long as it's your homestead they usually can't place a lien on it. Now if they can prove you've moved out... I don't know how that would work.

I've always been under the impression they needed an actual judgement to file a lien like that - unless you unknowingly signed something with the debt consolidator.

Get a copy of the lien from the county and work backwards from there - for starters.
