My Father recently passed away without a will leaving my sister and I the administrators of his Estate. There is a female companion that my father lived with for 30 years who is still living on the property. We would like to get her out of the house. She is not a beneficiary of the estate. What is the law in Virginia in evicting after obtaining the property?

If the two of you are now the owners of the property then she would be your tenant. Assuming she did not have any written lease with your father, she would be a "periodic" tenant (month-to-month).

To terminate this type of tenancy you will need to give her a written notice. 30 days is pretty standard, but it does vary by location. At the top of this forum there is a "sticky" for each state's landlord / tenant laws. Look at that and determine the length of time the notice needs to be for, as well as what steps you'll need to follow if she's not out at the end of that time.

You give them notice to have to move, or give them notice that they will have to now start paying rent. I would go in ASAP and inventory all of your fathers property, including video so that she does not take off with his belongings.

I may be legal to do so, but I wouldn't throw his companion of 30 years on the street.
